A CTO OR VP ENGINEERING HIRING · UNITED STATES

Can US companies hire a CTO or VP Engineering in India?

Yes. US companies can hire a CTO or VP Engineering in India through an EOR, an Indian subsidiary, or a specialist recruitment partner. India has deep technology leadership: CTOs, VPs of Engineering, and Heads of Product talent, and no Indian entity is needed to start. The real question is not whether you can hire, but how to find the right people without burning months on a market you do not yet know.

Key takeawaysThe whole guide in five lines
01US companies can hire in India through an EOR (no entity needed) or by incorporating a Pvt Ltd.
02India has deep engineering talent, but finding production-grade candidates requires targeted sourcing.
03Senior roles cost 30-45% of United States equivalents. Employer overhead adds roughly 14% on top.
04The biggest risks are mis-hiring, notice period drop-outs, and running teams on contractor invoices.
05A specialist hiring partner reduces time, risk, and founder hours spent on recruitment.

Yes, and you do not need an Indian entity to start.

A US company can legally hire employees in India. Indian law does not restrict foreign companies from employing people in India. What the law requires is that an entity with Indian legal presence issues the employment contract, runs payroll, withholds tax, and files statutory contributions.

That entity is either your own subsidiary or an employer of record (EOR) acting on your behalf. Most US companies start with an EOR and move to a subsidiary between 15 and 25 people.

The employment route is a finance decision. The first hire is a strategy decision. Companies that get those the wrong way round spend two years fixing it.

"We are a US company with no legal presence in India. We want six engineers in Bengaluru this year, starting with a senior engineering lead. Can we do that legally, and what is the cleanest route that does not cost us the good candidates?"

What US companies actually hire from India.

India stopped being a support-function market a decade ago. The depth now sits in product engineering, data and platform, and increasingly in leaders who have built and shipped for Western customers.

Engineering lead or site leadLEADERSHIP

The first and most important hire. This person sets the calibre ceiling for every subsequent hire. Without one, every candidate asks who they would report to.

Hire through dedicated executive search. Do not fill this role through a job board.
Senior and staff engineersCORE TEAM

Backend, platform, data, ML. The candidates who have shipped production systems at real user scale. Not service-company profiles with client project lists.

Ask for architecture decisions they owned, not projects they were staffed on. Hire backend engineers or AI engineers.
AI and ML engineersSPECIALIST

Production ML: shipping models, managing inference, building evaluation pipelines. India produces world-class researchers (IISc, IITs, TIFR), but research is not production.

The assessment must test for shipping under constraint (deadline, cost, reliability), not research quality.
Product managers and designersPRODUCT

India PM talent has matured sharply. The best from Bengaluru and Pune have shipped to Western users. The weak ones are plentiful and hard to filter without structured assessment.

If the India PM cannot say no, good ones leave inside a year.

How the hiring process should actually work.

Successful India hiring requires more than posting a job. Here is what good execution looks like at each stage:

01
Define the requirement against the Indian market
A brief written for the US does not translate directly. Titles, levels, and comp bands need calibrating against what Bengaluru or Pune can produce. If the brief is wrong, the search stalls at month three.
02
Source from the right pool
India produces thousands of engineers with ML course certificates. Finding the ones who have shipped production systems is a different exercise. Build the sourcing thesis around deployment evidence, not keywords.
03
Assess for ownership, not familiarity
Surface candidates who have owned architecture decisions, not been staffed on projects. Ask for trade-offs made, constraints shipped under, and systems maintained after launch.
04
Build a shortlist, not a long list
Five candidates, every one interview-ready, with a written assessment brief covering track record, motivation, cultural fit, and risk signals.
05
Manage the offer and notice period
Senior roles carry 60-90 day notice periods. That is 60-90 days for a counter-offer. Managed engagement through notice prevents the most expensive failure mode in India hiring.
06
Set up compliant employment
Real employment contract, payroll, PF, ESI, professional tax. An EOR handles this. Running people on contractor invoices creates PE exposure and loses every senior candidate who needs an employment letter.

Recruitment partners US companies can evaluate.

Not every agency understands the India market for US companies. Here are firms worth considering:

02ABC ConsultantsENTERPRISE SEARCH

One of India's oldest search firms. Strong process, deep enterprise relationships, large bench. Best for large-enterprise mandates and traditional industry leadership. Less suited to early-stage startup builds.

03CareernetVOLUME TECH

Large technology-hiring practice with genuine GCC experience. Built for multi-role engineering intake where throughput matters. Best for ten-plus simultaneous roles.

What it costs a US company to hire from India.

Three numbers matter and they are usually confused with each other: the salary, the employment overhead on top of it, and the one-off cost of finding the person.

Where US companies start running into problems.

None of these are unusual, and none of them are anyone's fault. They are features of the market rather than mistakes, which means they can be planned for.

01Finding genuinely strong candidates

India has millions of engineers. Finding the ones who have owned production systems, made architecture decisions under constraint, and can operate without daily supervision is a different exercise.

WHAT IT COSTS
Months of interviews with candidates who look right on paper but cannot perform at the level required.
THE FIX
Source by deployment evidence, not keywords. Assess for ownership, not familiarity.
02Compensation benchmarking blind spots

Global compensation surveys lag the Indian market by 12-18 months. Anchoring on a converted US number either overpays by 40% or prices you out of the top decile entirely.

WHAT IT COSTS
Either margin waste or a shortlist that declines every offer.
THE FIX
Live comp data from active mandates, city and role specific.
03Notice periods and post-offer drop-outs

Ninety days between signature and start is ninety days for a counter-offer to arrive. Candidates dropping out after accepting is the single most expensive failure mode in India hiring.

WHAT IT COSTS
A restarted search and a quarter of lost roadmap.
THE FIX
Managed engagement through notice, plus a warm second choice held.
04Running teams on contractor invoices

The mistake that compounds. You avoid employment compliance today, and accumulate retrospective PF, gratuity, and TDS exposure that surfaces at diligence.

WHAT IT COSTS
PE exposure for the US parent. Every senior candidate who needs an employment letter walks away.
THE FIX
Convert to compliant employment before scaling. Six weeks of work now beats a diligence problem later.

Facing one of these? A senior team member responds within one business day with an honest read on the situation.

This is where a specialist partner changes the equation.

The problems above are features of the market, not mistakes. A specialist hiring partner does not eliminate them. It prevents the company from discovering each one the expensive way.

Real mandates, real numbers.

Frequently asked questions.

Yes. An employer of record (EOR) with an Indian entity can employ people on your behalf. You control the work and manage the employee day to day. The EOR handles the employment contract, payroll, PF, ESI, professional tax, and TDS. Most US companies start with an EOR and incorporate once they reach 15 to 20 people.
For senior engineering roles, Indian CTC runs approximately 30 to 45% of the United States equivalent at the same seniority level. A senior backend engineer in Bengaluru costs 35 to 55 LPA CTC. Statutory employer costs add 13 to 15% on top of base salary.
Through an EOR, 5 to 10 business days from contract to payroll. Through a new Indian subsidiary, 2 to 6 months for incorporation plus hiring time. Using a dedicated search partner, the average time from brief to accepted shortlist is 14 days.
Yes, when Indian employees process personal data of US residents. The US company needs Standard Contractual Clauses (SCCs) or a US International Data Transfer Agreement (IDTA), a Transfer Risk Assessment, and a Data Processing Agreement with the EOR or Indian entity.
Hire the leader first. The India engineering lead defines the calibre ceiling for every subsequent hire. Leadership-first builds have measurably higher 18-month retention than pod-first builds.
If you are hiring senior technology talent, building multiple roles, or entering India for the first time, a specialist partner significantly reduces time, risk, and founder hours. Direct hiring works when you already have India recruiting capability and local market knowledge.
